FENRAD Call for Urgent Review and Action on ASOPADEC’s Operations

The Foundation for Environmental Rights Advocacy and Development (FENRAD Nigeria) is deeply concerned about recent developments within the Abia State Oil Producing Areas Development Commission (ASOPADEC). Through extensive consultations and assessments, we have identified critical issues that require immediate attention from the Abia State Government.

  1. The Observations
    The policies adopted by the Abia State Government in recent times have raised serious concerns among civil society, community-based organizations, and stakeholders in oil-producing areas. FENRAD Nigeria, as an advocate for environmental justice, has observed that the commission is not fulfilling its core mandate effectively. We urge the state government to simplify its language and ensure transparency in its activities.
  2. Non-Compliance with Established Law:
    ASOPADEC, established by Law No. 9 of 2009, has fallen short of complying with the legal framework that birthed it. Despite the law’s provisions for the appropriation of 30% from the 13% derivation funds to fund the commission, our observations indicate a lack of implementation. The commission must align with the law to serve the intended beneficiaries adequately.
  3. Transparency and Accountability:
    FENRAD Nigeria is concerned about the perceived lack of transparency and accountability in ASOPADEC’s operations. The current administration, led by His Excellency Dr. Alex Otti, appointed a General Manager, a position not recognized by the law establishing ASOPADEC. This departure from the legislative provisions raises questions about the government’s commitment to transparency and accountability.
  4. Call to Action:
    In light of the above, FENRAD Nigeria, in collaboration with various communities in oil and gas host regions, makes the following demands:
  • The Abia State Government and the House of Assembly should review the ASOPADEC law, ensuring alignment with current socio-economic realities.
  • The House of Assembly must expedite the overdue review and amendment of the ASOPADEC law.
  • Oversight should be exercised on the executive’s decision to appoint a General Manager, and the delay in constituting the ASOPADEC board should be addressed promptly.

FENRAD Nigeria emphasizes the need for a comprehensive review of ASOPADEC’s operations to ensure its adherence to the law and effective service delivery to the people of Abia State.
